COMPLAINT MECHANISMS
If a woman who is a victim of violence feels
that she has
not been treated appropriately by state
officials dealing with her case, or by any other person
or entity that assists her in relation to such
an incident, she is entitled to lodge a complaint against them. The contact details
for useful institutions for women to approach for assistance,
depending on the nature of the complaint, appear below.
COMPLAINTS AGAINST THE
POLICE
If a woman is treated
badly by the police, or she feels that the investigating
officer assigned
to her case is
not investigating it properly, a
complaint may be laid with the station
commissioner
of the station where the police
officer is based.
If the woman is unhappy with the station commissioner's
response,
she can approach the area commissioner
(responsible
for all the police stations in his/her
area) or the provincial commissioner (who is
responsible
for all the police in their province). Alternatively, she
can approach the MEC for Safety and Security for the province (who is the political representative
of the provincial police and security
services).

THE PUBLIC PROTECTOR (PP)
The Public Protector (PP) has been appointed in terms
of the Constitution to receive
complaints against the government, including any of its agencies
or officials. This encompasses
police, clerks of the court, prosecutors,
magistrates
and state doctors. For example, the PP will deal with complaints about improper administration
of cases,
which may result in prejudice, or instances
of improper, discourteous conduct.
The functions of the Public Protector are to:
- investigate complaints of abuse
of power, maladministration, dishonesty
and prejudice in the conduct of public officials
- recommend actions to solve such
problems, including suggestions for changes
to the system
- issue
reports to Parliament, which will
debate the matter and ensure that
the recommendations are followed.
The Public Protector has the power to investigate:
- government at any level
- any person performing a public
function, including police officers
and court officials
- corporations or companies where the state
is involved, for example Telkom and
Eskom
- statutory councils, for example the Human Sciences Research
Council.
The PP also has
the power of search and seizure.
Procedure for laying a complaint
with the Public Protector
The PP may investigate conduct of a state official:
- on its own initiative
- on a referral from another independent complaints
body
- or on receipt of a complaint from a member of the public.
If your client is experiencing problems
with any police officer or court official, and has
had no success with assistance
from any of their seniors, she
may approach the Public Protector by writing a letter to the Protector's office. The letter should
contain the following information:
- the nature of the complaint
- the background and history of the
complaint
- the steps
your client has taken to solve the problem (including relevant names, dates,
and documentation)
- a telephone number where your client may be contacted, if possible
- and in some cases, a statement under oath from your client.
If your client is unsure
about whether the PP can assist her,
she can call the Protector's office for an answer.
If she would prefer a personal interview, it is
advisable that she writes
first to ask
for one. The PP may decide that there is
someone better to deal with the
complaint and in that case will
refer it to the most appropriate
body. The complaint must be lodged
with the PP within two years of the
conduct giving rise to the
complaint. However, in exceptional circumstances, the PP may use
her/his discretion
to extend this. Generally, the PP
does not deal with complaints related to race issues, as this is the brief of the Human Rights
Commission.
Once a complaint has been made, it will then be investigated. The investigation
may take the form of inquiries
and/or hearings with the government
department responsible for the conduct. Depending on these results, the PP may:
- refer the complaint to the police for investigation
and/or the relevant authorities for
prosecution
- refer the matter for mediation, conciliation or negotiation
- make recommendations to the
relevant government department as to
how to resolve the complaint.
Investigations are conducted informally. However, the PP may summons
people to give evidence under oath when necessary. In some
cases,
the PP may refer your client to court, and since
the Protector does not act as a legal representative,
your client will be referred to a lawyer.
Limitations of the Public Protector
The Public Protector cannot or will not investigate:
- judgements by judges or magistrates, including sentences;
- private acts by individuals;
- acts by private companies;
- acts by doctors or lawyers
who are not working for the state.
